Several firearms experts testified that this was bogus, and there were several instances of .44 Magnums being used by hunters, where the bullets failed to knock over stationary deer, let alone deer moving in the direction of the shot. This and several other details convinced the jury that Peairs had not had sufficient reason to believe Hattori was a threat, and had thus fired without sufficient cause.
